1.3. These Terms and Conditions are made available before a purchase is completed. The provisions concerning consumers apply to individuals purchasing products for non-professional purposes, in accordance with applicable law. Sales to businesses and professionals may be subject to separate terms.
1.4. Peeth may update these Terms and Conditions without retroactive effect on orders already placed. The version in force on the purchase date shall apply, without prejudice to consumers' mandatory statutory rights.
2. Products and availability
2.1. Peeth provides information on the main features, composition, sizes, prices and intended use of its products on the relevant product pages, without prejudice to the instructions and warnings accompanying them.
2.2. Photographs are for illustrative purposes. Colour differences may arise due to screens and lighting, but the products delivered must conform to the essential characteristics advertised.
2.3. All sales are subject to stock availability. If a product becomes unavailable after an order has been placed, Peeth will inform the customer and comply with any applicable statutory rights to a refund or other remedy.
2.4. Medical devices must be used in accordance with their instructions for use, indications and warnings.
3. Prices and promotions
3.1. Prices are displayed in euros (€) and include Value Added Tax (VAT) at the applicable statutory rate, unless expressly stated otherwise where permitted by law.
3.2. Before an order is confirmed, the total price, applicable taxes and any delivery charges are displayed.
3.3. Peeth may change product prices, promotions and its product range without affecting orders already completed. Promotions comply with the legal requirements concerning price indications and price reductions.
4. Orders, payment and invoicing
4.1. To place an order, the customer selects the products and quantities, provides the required information and confirms the purchase after reviewing the shopping cart, delivery address, shipping charges and total amount payable.
4.2. Completing an order entails an obligation to pay. The accepted payment methods are those displayed at checkout, including, where available, debit or credit cards and bank transfer. Cheques are not accepted.
4.3. Orders are dispatched after payment has been confirmed. Peeth sends an order confirmation to the email address provided by the customer and issues an invoice in accordance with applicable law.
4.4. Customers must provide accurate delivery and billing details and report any errors as soon as possible.
5. Dispatch, shipping charges and delivery
5.1. Peeth delivers to mainland Portugal, the Autonomous Region of the Azores and the Autonomous Region of Madeira.
5.2. The following shipping charges apply, inclusive of applicable taxes:
- Mainland Portugal — orders below €15.00: €2.90.
- Mainland Portugal — orders of €15.00 or more: free shipping.
- Azores — orders of any value: €15.00.
- Madeira — orders of any value: €15.00.
5.3. The shipping threshold is calculated based on the value of the products after applicable discounts and before shipping charges. The final amount, including shipping, is displayed before the purchase is confirmed.
5.4. For products in stock delivered to mainland Portugal, the normal delivery period advertised is up to two working days after payment confirmation, unless a different timeframe is indicated before the purchase is completed. For the Azores and Madeira, the delivery timeframe is the one communicated to the customer during checkout.
5.5. Deliveries are carried out by a transport company. In the event of a delay or inability to deliver, Peeth will inform the customer and respect all statutory rights relating to failure to meet the agreed delivery period.
5.6. Customers are advised to check the condition of the packaging upon receipt and report any damage or irregularities. Failure to report an issue immediately does not limit their statutory rights regarding product conformity.
6. Right of withdrawal — 14 days
6.1. For distance sales contracts, consumers generally have 14 consecutive days to exercise their statutory right of withdrawal without giving any reason and without penalty, under Portuguese Decree-Law No. 24/2014 of 14 February, as amended, subject to the statutory exceptions.
6.2. As a general rule, the period begins on the day the consumer, or a third party indicated by the consumer other than the carrier, takes physical possession of the product. Where several products in the same order are delivered separately, the period runs from receipt of the final product, where required by law.
6.3. To exercise this right, the consumer must notify Peeth of their decision by an unequivocal statement, for example by email to geral@peeth.pt or by post to the address in clause 6.5. The model withdrawal form at the end of this document may be used but is not mandatory. Notification must be sent before the statutory withdrawal period expires.
6.4. After notifying Peeth of the decision to withdraw, the consumer has 14 days to return the goods. This deadline is met if the goods are sent before the 14-day period has expired.
6.5. Returns address: Peeth — Returns, Estrada Luiz Bernardo de Almeida, No. 340, Macieira de Cambra, 3730-221 Vale de Cambra, Portugal. Products must be appropriately packaged and accompanied by sufficient information to identify the order.
6.6. Return shipping costs in the event of withdrawal. If the consumer exercises the statutory right of withdrawal, the direct cost of returning the products shall be borne entirely by the consumer. The consumer is responsible for arranging and paying for return transport to Peeth. This information is provided in advance pursuant to Article 13(2) of Portuguese Decree-Law No. 24/2014. This rule does not apply to returns resulting from a lack of conformity or other situations in which the law requires Peeth to bear the costs.
6.7. Consumers may inspect products to the extent necessary to establish their nature, characteristics and functioning. They may be liable for any diminished value resulting from handling beyond what is necessary for that purpose, as provided by law. The absence of the original packaging does not, in itself, exclude the right of withdrawal.
6.8. Exceptions. The right of withdrawal does not apply in the situations expressly set out in Article 17 of Portuguese Decree-Law No. 24/2014, including personalised goods and sealed goods that are unsuitable for return for health protection or hygiene reasons once unsealed after delivery, only where all legal conditions for the relevant exception are met. Opening packaging or trying on a product does not, by itself, automatically trigger this exception. Where applicable, any exclusion of the right of withdrawal will be identified in the information provided before purchase.
7. Refunds following withdrawal
7.1. In the event of a valid withdrawal, Peeth will refund the payments due under applicable law without undue delay and within a maximum of 14 days from receipt of the withdrawal notice.
7.2. Where an entire order is returned, the refund includes the price of the products and the initial shipping charge corresponding to the least expensive standard delivery method offered for the destination. It does not include additional costs resulting from the consumer's express choice of a more expensive delivery method.
7.3. Peeth may withhold the refund until it has received the returned goods or the consumer has provided evidence of having sent them back, whichever occurs first, unless Peeth has offered to collect them.
7.4. Refunds will be made using the same payment method as the original purchase, unless expressly agreed otherwise, at no additional cost to the consumer. Partial returns will be refunded in accordance with applicable law.
8. Statutory warranty and lack of conformity
8.1. Goods sold to consumers are covered by the conformity rules established by Portuguese Decree-Law No. 84/2021 of 18 October, as amended. For new movable goods, Peeth is generally liable for any lack of conformity that becomes apparent within three years of delivery.
8.2. Where goods lack conformity, the consumer has the statutory rights available under the applicable conditions, including repair, replacement, a proportionate price reduction or termination of the contract.
8.3. If a lack of conformity becomes apparent within the first 30 days following delivery, the consumer may exercise the statutory right of rejection and request immediate replacement or termination of the contract, as provided by law.
8.4. Remedies to bring goods into conformity are provided at no cost to the consumer, including applicable transport costs. To report a problem, the consumer may contact geral@peeth.pt, identifying the order and describing the issue.
8.5. Damage demonstrably caused by misuse, negligence or use contrary to the product instructions does not, in itself, constitute a lack of conformity attributable to Peeth. This provision does not restrict the consumer's statutory rights.
9. Product exchanges
9.1. Requests to exchange goods due to personal preference, including a different size, model or colour, outside situations protected by law, are subject to Peeth's acceptance and the conditions communicated to the customer.
9.2. This provision does not affect the statutory right of withdrawal or consumers' rights in cases of lack of conformity.
10. Personal data protection
10.1. Peeth processes the personal data necessary to manage orders, payments, invoicing, dispatch, customer support and compliance with legal obligations, in accordance with the General Data Protection Regulation (GDPR) and applicable Portuguese law.
10.2. Further information on processing purposes, legal bases, retention periods, data subjects' rights and the use of cookies is provided in the Privacy Policy and Cookie Policy available in the online shop.
10.3. For questions about personal data processing, customers may contact geral@peeth.pt.
11. Contact details, complaints and dispute resolution
11.1. For information, support or complaints, customers may contact Peeth at geral@peeth.pt, by telephone on +351 256 422 282 (call to a Portuguese fixed-line network), or at the address indicated in clause 1.2.
11.2. Customers may use the Portuguese Electronic Complaints Book (Livro de Reclamações Eletrónico) at www.livroreclamacoes.pt.
11.3. In accordance with Portuguese Law No. 144/2015 of 8 September, consumers may refer disputes to the competent consumer Alternative Dispute Resolution (ADR) bodies, including CICAP — Centro de Informação de Consumo e Arbitragem do Porto, Rua Damião de Góis, No. 31, Shop 6, 4050-225 Porto, Portugal; telephone +351 225 508 349; email cicap@cicap.pt; website www.cicap.pt.
11.4. For consumer disputes of low economic value, currently up to €5,000.00, Peeth is subject to mandatory arbitration when the consumer expressly chooses that option in accordance with applicable law.
12. Governing law and final provisions
12.1. These Terms and Conditions are governed by Portuguese law, without prejudice to mandatory consumer-protection provisions and applicable rules on court jurisdiction, including in cross-border cases.
12.2. No provision of these Terms and Conditions excludes or limits consumers' mandatory statutory rights. If any provision is held to be invalid, the remaining provisions shall continue to apply to the extent permitted by law.
12.3. These Terms and Conditions are available in the online shop for consultation, storage and reproduction.
